Privacy policy

For the purposes of this section, Personal Information will be understood in accordance with the definition provided in the Protection of Personal Information Act 4 of 2013 ("the Act"). Noulega also subscribes to the principles for electronically collecting personal information outlined in the Act, and the further legislation referred to therein. We endeavour to ensure the quality, accuracy, and confidentiality of Personal Information in our possession.
In adopting this Privacy Policy, we wish to balance our legitimate business interests and your reasonable expectation of privacy. Accordingly, we will take all reasonable steps to prevent unauthorised access to, or disclosure of your Personal Information. However, it is impossible to guarantee that your Personal Information shall be 100% secure.  
Users will be prompted to register an account with Noulega. In so doing, users may be asked to provide the following information (Personal Information):
  • First name
  • Surname
  • Email
  • Phone number
  • Physical address
We will attempt to limit the types of Personal Information we process to only that to which you consent to (for example, in the context of online registration, newsletters, message boards, surveys, polls, professional announcements, SMS, MMS and other mobile services), but, to the extent necessary, your agreement to these this Privacy Policy constitutes your consent as contemplated in section 69 of the Act.
All payment information will be captured through the Website. Further, Noulega shall not retain payment information on behalf of its users.
We will not collect, use, or disclose sensitive information (such as information about racial or ethnic origins or political or religious beliefs, where relevant) except with your specific consent or in the circumstances permitted by law.
By agreeing to the terms contained in this Privacy Policy, you consent to the use of your Personal Information in relation to:
  • The provision and performance of the services;
  • Informing you of changes made to our website;
  • The provision of marketing related services to you by Noulega;
  • Responding to any queries or requests you may have;
  • Developing a more direct and substantial relationship with users for the purposes described in this clause;
  • Developing an online user profile; 
  • Understanding general user trends and patterns so that we can develop and support existing and ongoing marketing strategies; 
  • For security, administrative and legal purposes; and
  • The creation and development of market data profiles which may provide insight into market norms, practices, and trends to help us improve our offering to you. Such information will be compiled and retained in aggregated form but shall not be used in any way which may comprise the identity of a user.
Although absolute security cannot be guaranteed on the internet, Noulega has in place up-to-date, reasonable technical and organisational security measures to protect your Personal Information against accidental or intentional manipulation, loss, misuse, destruction or against unauthorised disclosure or access to the information we process online.
While we cannot ensure or warrant the security of any Personal Information you provide us, we will continue to maintain and improve these security measures over time in line with legal and technological developments.
We store your Personal Information directly, or alternatively, store your Personal Information on, and transfer your Personal Information to, a central database. If the location of the central database is located in a country that does not have substantially similar laws which provide for the protection of Personal Information, we will take the necessary steps to ensure that your Personal Information is adequately protected in that jurisdiction.
Your information will not be stored for longer than is necessary for the purposes described in these Terms or as required by applicable legislation.
The Personal Information Noulega collects from users shall only be accessed by Noulega employees, representatives and consultants on a need-to-know basis, and subject to reasonable confidentiality obligations binding such persons.
Noulega shall have the right, but shall not be obliged, to monitor or examine any information and materials including any website link that you publish or submit to Noulega for publishing on the Site.  You shall be solely responsible for the contents of all material published by yourself.
We constantly review our systems and data to ensure the best possible service to our users. We do not accept any users, or representatives of users, under 18 years of age or who otherwise does not have the relevant capacity to be bound by this Privacy Policy.
We will not sell, share, or rent your Personal Information to any third party or use your e-mail address for unsolicited mail. Any emails sent by Noulega will only be in connection with the provision of our services and/or the marketing thereof. 
Personal information we collect 
When you visit the Site, we automatically collect certain information about your device, your interaction with the Site, and the information necessary to process your purchases.
We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information about an identifiable individual (including the information below) as “Personal Information”. See the list below for more information about what Personal Information we collect and why.

    • Purpose of collection: to load the Site accurately for you, and to perform analytics on Site usage to optimize our Site.
    • Source of collection: Collected automatically when you access our Site using cookies, log files, web beacons, tags, or pixels
    • Disclosure for a business purpose: shared with our processor Shopify
    • Personal Information collected: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site 
  • Order information
    • Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
    • Source of collection: collected from you.
    • Disclosure for a business purpose: shared with our processor Shopify
When you register an account and make a purchase or attempt to make a purchase through the Site, we collect certain information from you, your name and surname, billing address, shipping address, payment information all payment information will be captured through the Website. Further, Noulega shall not retain payment information on behalf of its users) identity number, date of birth, your business details if registered as a business, email address, and phone number. We refer to this information as “Order Information”. 

In addition, Noulega may collect, store and use personally identifiable information from you, including your age, gender, product information ordered, etc. 

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information. 
No credit card information is stored on Noulega servers in the form of cookies. Noulega use secure and reputable payment processors. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with 2048-bit encryption, the highest level encryption available. Although no method of transmission over the Internet or electronic storage is 100% secure, Noulega payment provider, Ozow follows PCI-DSS Level 1 requirements and implement additional generally accepted industry standards.
How do we use your personal information? 
We use the Order Information that we collect generally to fulfil any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to: 
- Communicate with you; 
- Screen our orders for potential risk or fraud;
  • Fulfil your order for products or services;
  • Ensure that products are received by you;
  • Solicit new members;
  • Conduct surveys and polls that will help improve our products and services and for operational reasons.; and 
When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services. 

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns). 
Data Retention
When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase this information. For more information on your right of erasure, please see the ‘Your rights’ section below.
Your rights
The information given by Noulega relating to the Protection of Personal Information Act4 of 2013 (“POPI”) of the Republic of South Africa for information purposes only.
Noulega warrants, represents, and undertakes that Personal Data shall comply with POPI including, but not limited to, its collection, holding, and processing.
Unsubscribed Email
Any user/client who wishes to opt out of Noulega can request to unsubscribe to any further marketing materials/email
Do Not Track
Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.
User Accounts
Users are responsible for maintaining the confidentiality of their account, user name and password for restricting access to their computer. The users agree to accept the responsibility for all the activities that occur under their account, user name and/or password. The Use agree to provide accurate and truthful information.  www.noulega.co.za reserves the right to refuse service and/or terminate accounts without prior notice if the user violate these terms and conditions of if Noulega decide, in our sole discretion that it would be in our best interest to do so.
Minors
The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address above to request deletion.

Noulega Platform(s) may contain links to third-party websites or services, such as third-party integrations or third-party branded services. Noulega does not own or control any of these third-party partners and when you interact with them, you may be providing information directly to the third-party providers, Noulega, or both. These third-party providers will have their own rules about the collection, use, and disclosure of information. We encourage you to review the privacy policies of the other websites you visit.
All content, logos, graphics, pages, scripts, and service names included in or made available through any third-party websites or services are subject to trade dress, trademarks, service marks, and/or copyright law and other laws that protect intellectual property. All other trademarks and service marks not owned by Noulega that appear in any third-party websites or services are the property of their respective owners, who may or may not be Noulega.
Links to other websites operated by third parties, including www.noulega.co.za vendors, do not constitute sponsorship, endorsement, or approval by Noulega of the content, policies, or practices of such linked sites. Noulega does not operate, control, or maintain linked sites and is not responsible and liable for their availability, content, security, policies, advise, or practices. Links to other sites are provided for your convenience only and you access them at your own risk. We make no representation or warranties of any kind, whether express or implied, by third party sites.
Application of the Electronic Communication and Transactions Act 25 of 2002 (“ECT ACT”)
Data Messages (as defined in the ECT Act) will be deemed to have been received by Noulega if and Noulega responds to the Data Messages.
Data Messages sent by Noulega to a user will be deemed to have been received by such user in terms of the provisions specified in section 23(b) of the ECT Act.
Users acknowledge that electronic signatures, encryption and/or authentication are not required for valid electronic communications between users and Noulega.
Information to be provided in terms of section 43(1) of the ECT Act:
Users warrant that Data Messages sent to Noulega from any electronic device, used by such user, from time to time or owned by such user, were sent and or authorised by such user, personally.

This Website is owned and operated by Noulega (Pty) Ltd, a private company owned and operated in accordance with the laws of the Republic of South Africa.
Sharing Personal Information
We share your Personal Information with service providers to help us provide our services and fulfil our contracts with you, as described above. For example:

  • We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Automatic decision-making
We do engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.
Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.
Services that include elements of automated decision-making include:
  • Temporary blacklist of IP addresses associated with repeated failed transactions. This blacklist persists for a small number of hours.
  • Temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist persists for a small number of days.
Cookies

We use a number of different cookies, including functional, performance, advertising, and social media or content cookies.
